Introduction
These Booking Conditions govern your booking with Sound Travel s.r.o., Company ID No. 29973368, with registered office at Za Poříčskou bránou 365/21, Karlín, 186 00 Prague 8, Czech Republic, a travel company authorised to organise, offer and sell packages ("we", "us" and "our"). These conditions form part of your contract together with the confirmation or contract we issue, the pre-contractual information we provide, and the description of the services in our catalogue, on our website or on the retailer's website. Please read them carefully; they set out our respective rights and obligations. References to "you" and "your" include the first-named person on the booking and everyone on whose behalf the booking is made or to whom it is transferred.
References to the start of the package mean the beginning of the first travel service included in the package. Where a package is sold through a retailer acting as our agent, a notice you give to the retailer is treated as given to us, and a payment you make to the retailer discharges you to that extent.
The booking is made by the first-named person on behalf of everyone named on it. That person confirms that they are authorised to make the booking for all of those persons and to provide us with their personal data, undertakes to pay the total price of the package, and guarantees the performance of the other travellers' obligations under the contract. Where a traveller is under 18 and is not accompanied by a legal guardian, the first-named person confirms that they are that traveller's legal guardian or that they have the guardian's consent.
Before the contract is concluded we will give you the detailed description of the package, the relevant statutory information form, the certificate of our insolvency-guarantee insurance and the general information on passport, visa and health requirements referred to in clause 6.
Unless the description of the package states otherwise, the first-named person must be at least 18. Everyone named on the booking must meet any age condition that the event organiser sets for the event included in the package.
Each package we sell combines an admission ticket to a cultural event (for example a concert or festival) with accommodation, and these terms apply to that package as a whole. The admission ticket is an essential feature of the package. Unless the description of the package states otherwise, the package does not include carriage.
We and you communicate regarding the package by email at the addresses stated in the confirmation of the package.
1. Booking and payment
Our packages can be ordered on our website or the website of a travel agent who is authorised by us to sell packages on our behalf. In order to do so, you choose a specific package, navigate through the reservation system, fill in all the necessary information and agree to all the necessary documents. After you click on the “order” button, you will be redirected to the payment gateway. The contract is entered into when you pay the price according to the instructions at the gateway. We will provide you with the confirmation of the package in text form after the contract is entered into.
Please check the confirmation and all documents when you receive them and tell us promptly if anything is wrong, so that we can correct it in time; the sooner you tell us, the more likely a correction can be made without additional cost.
2. Prices and accuracy
The price of a package is a total price and includes all taxes, fees and other charges and any further costs. Where further costs cannot reasonably be calculated before the contract, we will state the type of cost that may still arise. Prices include VAT. Prices are stated in the currency shown at the time of booking. Small local charges, such as a city or tourist tax (typically a few euros), are payable directly at the accommodation.
We endeavour to ensure that all the information and prices on our website or the website of a travel agent who is authorised by us to sell packages on our behalf are accurate, however, occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. Therefore, the binding price is the one shown right before you pay the price, in accordance with clause 1.
3. Travel insurance
Adequate travel insurance is strongly recommended. If you take out travel insurance, you should satisfy yourself that it covers all your personal requirements including pre-existing medical conditions, cancellation charges (including event cancellation), medical expenses and repatriation in the event of accident or illness.
4. Requests
You can make requests regarding your booking (for example diet, room location or a particular facility). The sooner you make your requests, the higher the chance that they will be fulfilled. We will pass reasonable requests on and make efforts to meet them, but we cannot guarantee they will be met, and a request noted on your documents is not a confirmation that it will be fulfilled unless we have expressly confirmed that the request will be met. We do not accept bookings that are conditional on a request being met.
5. Health and reduced mobility
Unless the detailed description of the package or the contract states otherwise, our packages are not suitable for persons with reduced mobility. If you or any traveller has a medical condition or reduced mobility that may affect the booking, please, contact us on [email protected] and we will try to direct you to the place where it is possible to purchase a similar package for travellers with such conditions.
6. Passports, visas and health formalities
It is your responsibility to hold a valid travel document and to meet the passport, visa, immigration and health requirements of the destination and any transit country, and to keep these under review, as they can change. We will provide general information on passport and visa requirements, including approximate visa processing times, and on the health requirements of the destination. We are not responsible where you cannot travel, or incur loss, because you have not met these requirements, and you agree to reimburse us for any fine or other loss we incur as a result.
7. Your conduct
You are expected to behave in an orderly manner and not to disrupt others. Where, in the reasonable opinion of us, a hotelier, an event organiser or another person in authority, your behaviour or that of any member of your party causes or is likely to cause serious danger, distress or annoyance to others or damage to property, or you seriously or repeatedly breach the rules of a supplier or our reasonable instructions, we will consider such behaviour a substantial breach of the contract. Where the package has not yet started, we may withdraw from the contract with the person in question under clause 11. Where the package has already started, we may instead terminate the contract with that person with immediate effect; in that case no refund is due for services not taken and that person bears the cost of their own onward arrangements. In either case you remain jointly and severally liable for any loss or damage caused by you or your party. We are not responsible for the acts of other travellers or of persons unconnected with your booking.
8. Changes to the price
We may increase the price of a confirmed package only where our costs increase as a direct result of a change in:
(a) the price of the carriage of passengers resulting from the cost of fuel or other power sources;
(b) the level of taxes or fees imposed by third parties not directly involved in the performance of the package (such as tourist or accommodation taxes); or
(c) the exchange rate relevant to the package.
The price increase is calculated as the difference between the cost used by us when calculating the price of the package and the actual cost that we must pay for the service in question at the time of notification of the price increase, converted to a per-traveller-affected basis. In the case of exchange rate differences, the calculation is based on the exchange rate used by us when calculating the price and the exchange rate applicable to the payment for the relevant service to the supplier.
We will send you notice of any increase, with the reason and the calculation, in text form no later than the twentieth day before the start of the package; a later notice has no effect. If the increase exceeds 8 % of the total price, you may either accept it or withdraw from the contract without paying a cancellation fee, within a period we will state of at least 5 days. If you withdraw, we will refund all payments made by you or on your behalf without undue delay and no later than 14 days after we receive your notice.
If the above costs fall, you are entitled to a price reduction; we may deduct the administrative costs actually incurred and will evidence them on request.
9. Changes by you and transfer of the booking
If you wish to change your booking after the confirmation is issued, tell us in text form as soon as possible. We will try to help but cannot guarantee a change is possible. You will pay the costs actually incurred by us or our suppliers, as a result of the change, the costs will always include at least the processing costs of EUR 30. If we cannot help and you do not wish to proceed according to the conditions of the contract you entered into, we will treat this as a cancellation under clause 10.
You may transfer the booking to a person who meets the conditions of participation, provided you give us notice in text form at least 7 days before the start of the package together with that person’s statement that they agree to the contract and meet those conditions. You and the transferee are jointly and severally liable for payment of the costs actually incurred in connection with the transfer, which we will evidence on request, the costs will always include at least the processing costs of EUR 30. Note that certain services, in particular admission tickets, may not be transferable by the event organisers, which will significantly increase the costs incurred when the whole booking is transferred to another person.
10. Cancellation by you and the cancellation fee
You may withdraw from the contract at any time before the start of the package. Unless you withdraw for one of the reasons set out below, you must pay a cancellation fee. The fee will not exceed the price of the package less the costs we save and any income we obtain from using the services otherwise, and we will justify the amount on request. Unless the contract states otherwise, the cancellation fee per person is as follows:
− 60 and more days before the start of the package – 75 % of the price,
− 59 and fewer days before the start of the package – 100 % of the price.
We will set off the fee against sums you have paid and refund any balance.
You may withdraw without paying a cancellation fee in the following cases:
a) where you withdraw within 48 hours after the contract is entered into, provided the start of the package is still 60 or more days away;
b) where unavoidable and extraordinary circumstances at the destination or its immediate vicinity significantly affect the package or your travel to it; in that case we will not owe you additional compensation;
c) where we increased the total price of the package by more than 8 % in accordance with clause 8;
d) where external circumstances forced us to significantly change the package and you did not agree to such change in accordance with clause 11; and
e) where the services are provided with a substantial defect we do not remedy in accordance with clause 13.
Where you withdraw for any of these reasons, we will refund all payments made by you or on your behalf without undue delay and no later than 14 days after the withdrawal.
11. Changes or cancellation by us
We may make insignificant changes and will tell you in text form, clearly; these do not give a right to a price reduction or to withdraw.
If external circumstances compel us to significantly change a main feature of the services, or we cannot meet a request which we expressly confirmed to be met, or we propose an increase of more than 8 %, you may accept the proposal or withdraw without a cancellation fee within a period we will state of at least 5 days ending before the start of the package. With the proposal we will give you, in text form, the effect on the price, the deadline to withdraw, the consequences of not withdrawing, and details of any substitute package and its price. If you do not withdraw within the period, you are treated as accepting the change. If the change lowers the quality or cost of the package, you are entitled to a reasonable price reduction.
We may withdraw from the contract before the start of the package:
a) if the stipulated minimum number of travellers is not reached, provided we notify you at least 20 days before the start of the package where it lasts more than 6 days, 7 days before where it lasts 2 to 6 days, or 48 hours before where it lasts less than 2 days. If not stipulated otherwise, the minimum number of travellers is 20;
b) if we are prevented from performing by unavoidable and extraordinary circumstances; or
c) if you or a member of your party breaches the contract substantially, in accordance with clause 7.
In the cases under (a) and (b) we will refund all payments within 14 days and owe no compensation. In the cases under (c) we will return your payments reduced by the loss we incur as a result, which we will evidence on request.
12. The event
Where the event included in the package is cancelled, postponed or rescheduled by the event organiser, we will tell you without undue delay and set out the options open to you.
Where the event is cancelled and no substitute event is offered, the package cannot be provided as agreed. You may withdraw from the contract without paying a cancellation fee and we will refund all payments made by you or on your behalf within 14 days, or you may accept a substitute package if we offer one.
Where the event is postponed or rescheduled to another date, we will offer you the package on the new date on the same terms where the accommodation is available for that date. If it is not, or if you do not accept the new date, you may withdraw from the contract without paying a cancellation fee and we will refund all payments within 14 days.
A change to the line-up, the running order or the supporting acts is not by itself a defect of the package.
13. Defects, remedies and complaints
We are responsible for the proper provision of all services included in the package. A package is defective if a service is not provided in accordance with the contract. You must notify a defect without undue delay, ideally on the spot, and set a reasonable period for it to be remedied, unless we refuse to remedy it or immediate remedy is needed. The defect should be notified through our local representative or us on [email protected] it is also possible to notify it through the retailer who sold the package. You will receive a confirmation of the notification.
We will remedy the defect unless it is impossible or involves disproportionate cost; if we do not, you may remedy it yourself and claim the necessary cost, and for a substantial defect you may withdraw without a cancellation fee. Where substantial defects arise after the start of the package, we will offer suitable alternative arrangements, where possible of the same or higher quality, at no extra cost, and a reasonable price reduction where they are of lower quality. If we do not remedy the defect and you notified it without undue delay, you are entitled to a price reduction proportionate to the defect’s extent and duration. You can claim for the price reduction on [email protected] and we will handle your claim within 30 days.
The limitation period for your price reduction claim is 2 years.
You also have the right to out-of-court resolution of a dispute before the Czech Trade Inspection Authority, Prague, www.coi.cz.
14. Assistance in difficulty
If you are in difficulty during the package, we will provide prompt appropriate assistance, in particular information on health services, local authorities and consular assistance, and help with distance communication and with finding alternative arrangements.
15. Liability for damage
We are liable for any damage and other harm caused by a breach of obligations by us or by our suppliers. We are not liable for damage where it was caused by you, by a third party unconnected with the provision of the services, or by unavoidable and extraordinary circumstances.
Where an international convention binding on the Czech Republic limits the amount of, or the conditions for, compensation payable, we are liable only within those limits. Our liability to pay damages is otherwise limited to three times the total price of the package, except for damage caused intentionally or negligently and for harm to health, for which no cap applies. Where we pay, we may deduct any sums you have received or are entitled to receive from a supplier for the same matter.
The limitation period for your compensation for damage claim is 2 years.
16. Insolvency protection
We hold insolvency-guarantee insurance with ERGO Cestovní Pojišťovna, a. s., Company ID No. 49240196, Křižíkova 237/36a, Karlín, 186 00 Prague 8, Czech Republic, which covers the refund of payments made where the package is not provided, the difference where only part of the package is provided, and, where the package includes carriage, repatriation from abroad. This protection applies to you regardless of your nationality and of the country from which you booked the package. We will give you the insurance certificate before the contract. In the event of our insolvency, you should contact ERGO Cestovní Pojišťovna, a. s. on +420 221 860 606 or [email protected]. Keep your confirmation as evidence of your booking.
17. Personal data
For the purposes of performing the contract and complying with our legal obligations, we process your personal data, in particular: name, surname, date of birth, the passport data necessary for the contract, bank details, residence or other contact address, email address, telephone number, and, where you give us your explicit consent, data on allergies, medication and other health conditions. We store all personal data only for the period required by law or otherwise strictly necessary.
To perform the contract, we also provide this information, to the extent necessary, to our suppliers (in particular hotels and event organisers), whose identification details are given in the contract and the travel instructions, or which you receive at the latest during the trip. Where your destination lies outside the European Economic Area, you acknowledge that your personal data will be provided to recipients in that third country (in particular hotels and event organisers). On request, we will tell you whether a European Commission adequacy decision exists for the transfer of personal data to the third country concerned.
We will also process your name, surname, address, telephone number and email address in order to send you commercial communications, which we may send by any means. You may object to this at any time, either at our address or by email to [email protected] we will then stop sending you commercial communications and stop processing your personal data for direct-marketing purposes.
These provisions apply, as appropriate, to the other persons named on the booking. Where we process data concerning their health, we will obtain their explicit consent directly; the first-named person cannot give that consent on their behalf.
As a data subject you have, in particular, the right to:
a) request access to your personal data;
b) request rectification of inaccurate or incomplete personal data;
c) request erasure of your personal data;
d) request restriction of the processing of your personal data;
e) object to the processing of your personal data;
f) request the transfer of your personal data to another controller;
g) withdraw at any time a consent you have given, without affecting the lawfulness of the processing carried out before the withdrawal; and
h) lodge a complaint with the supervisory authority, the Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Prague 7.
18. Governing law and jurisdiction
The contract and these Booking Conditions are governed by Czech law, without prejudice to the mandatory protection a consumer enjoys under the law of their habitual residence. Disputes will be decided by the Czech courts. Where you are a consumer domiciled in a Member State of the European Union, this does not affect your right to bring proceedings in the courts of your domicile, nor our obligation to bring proceedings against you in those courts, nor your right to out-of-court resolution before the Czech Trade Inspection Authority.
19. Final provisions
If a provision of these conditions is or becomes invalid, the remaining provisions are unaffected.
